Rotten Tomatoes may modify these Terms and Conditions may at any time. You agree not to use any system, processes, technologies, programming, or other methods to modify, disable, subvert, or otherwise change the mechanism by which the sweepstakes operates. Please review this Agreement from time to time since your ongoing use is subject to the terms and conditions as modified. You are also subject to the Privacy Statement, which is hereby made a part of and incorporated by reference into these Terms and Conditions. If you do not agree to these Terms and Conditions, do not register with Rotten Tomatoes and do not enter The Sweepstakes.

Sweepstakes Rules

1. To enter The Sweepstakes, click on the "Enter Sweepstakes" button and fill out the form.
2. Only one entry per person. Persons determined to have entered multiple times will be disqualified.
3. Entrants must be legal residents of the United States.
4. Winner of each prize will be randomly selected on the date specified on the Entry Page. All entries must be received by 12:01 pm PT on in order to qualify.
5. Participants must register a valid email and mailing address in order to claim the prize. By submitting his/her email address, winner agrees to The Sweepstakes Terms and Conditions. It is the responsibility of winner to submit the correct email and mailing address. Rotten Tomatoes cannot be held responsible for incorrect, invalid, or mistyped email and mailing addresses.
6. A notification confirming a winning entry will be sent to winner via email once an address has been submitted. Rotten Tomatoes will contact the winner via email in inform them of the delivery of prize(s). The winner's shipping address will be used ONLY for delivery of the prize(s).
7. Prize(s) will be sent to the winner via United States Postal System first class mail within 2-4 business weeks of receiving shipping information. Prize(s) will be sent to United States mailing addresses only.
8. Winner's initials, hometown, and state may be listed on the Winners Page on the Rotten Tomatoes site. No other personal information will be made available to the public.
9. Rotten Tomatoes agrees to exercise its best effort to ensure proper delivery of prize(s). However, if winner does not respond within one week from the day the initial winning notification is sent, Rotten Tomatoes reserves the right to void the winner entry. Prizes for voided entries will be made available for the sweepstakes after one week.
10. The Sweepstakes is void where prohibited.

The rights to this information may be protected by patent, copyright, trademark, trade secrets or other proprietary rights owned by a third party other than Rotten Tomatoes. Additionally, certain content displayed and contained within the Rotten Tomatoes website is the original authorship of Rotten Tomatoes and is owned exclusively by Rotten Tomatoes. If for any reason, if The Sweepstakes is not operating as intended, as a result of infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Rotten Tomatoes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the sweepstakes, Rotten Tomatoes reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. Rotten Tomatoes assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Rotten Tomatoes is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Rotten Tomatoes on account of technical or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this sweepstakes.

The Sweepstakes are provided to you "as is" and you agree to use it at your sole risk. Rotten Tomatoes expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

You expressly understand and agree that Rotten Tomatoes shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Rotten Tomatoes has been advised of the possibility of such damages), resulting from:

1. the inability to participate in The Sweepstakes;
2. the cost of procurement of substitute goods and services resulting from any goods, data, information or services won, purchased or obtained via Rotten Tomatoes;
3. unauthorized access to or alteration of your transmissions or data;
4. statements or conduct of any third party on Rotten Tomatoes; or
5. any other matter relating to Rotten Tomatoes or operation of The Sweepstakes. In no event shall Rotten Tomatoes' total liability to you for all damages, losses and causes of action whether in contract, tort (including, but not limited to, negligence), or otherwise exceed the amount paid by you, if any, for accessing this site.

By participating in the sweepstakes, each contestant agrees to release and hold harmless Rotten Tomatoes, its parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any sweepstakes related activity, use of the Rotten Tomatoes website, or participation in the sweepstakes, and any claim or cause of action of any kind in connection with the sweepstakes, including without limitation, injury, death, property damage and claims based on right of privacy or publicity, or defamation. By participating in the sweepstakes or game, each Contestant further agrees that any dispute arising out of or relating to any sweepstakes or game offered by Rotten Tomatoes, its parents, affiliates, subsidiaries, advertising and promotion agencies, and their respective directors, officers, employees, representatives and agents, shall be submitted to and resolved by binding arbitration in Emeryville County California, pursuant to the rules and standards established by the American Arbitration Association ("AAA"), except where the rules or standards of the AAA conflict with any provision included in the rules of any sweepstakes or game offered by Rotten Tomatoes. In such instance of a conflict, the Contestant agrees that the arbitrator shall apply the rules of the sweepstakes or game. By participating in this sweepstakes or game, Contestant also agrees that each Contestant shall only be permitted to represent his/her own individual claims or defenses in the arbitration proceeding. Class arbitration is expressly prohibited. Further, the Contestant agrees that the arbitrator shall not have the authority to award attorney's fees or costs, or to award punitive or exemplary damages.

Registration

You agree that the information you provide to Rotten Tomatoes is true and accurate information about you, and that you will notify Rotten Tomatoes if any of this information changes. If you fail to provide true and accurate information, Rotten Tomatoes reserves the right to terminate your registration with Rotten Tomatoes.

Rotten Tomatoes closely monitors all sweepstakes activities on the Rotten Tomatoes website. In the event Rotten Tomatoes determines that you have violated these Terms and Conditions, the Sweepstakes Rules or the Privacy Statement, it reserves the right to cancel your registration and cancel your entries from any sweepstakes you have entered.

Miscellaneous

These terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in the State of California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. These Terms and Conditions, the Sweepstakes Rules and the Privacy Statement constitute the entire agreement between you and Rotten Tomatoes relating to the subject matter herein and shall not be modified except as provided herein. Participation in The Sweepstakes is void where prohibited by law.
